Aged Care Justice Fact Sheets
ACJ has developed Fact Sheets on Frequently Asked Questions by aged care residents, home care recipients and their families, so the aged care community can learn about the rights of older Australians and the obligations of aged care providers. ACJ connects callers to lawyers for a free legal consultation to discuss their aged care issue.
Below are the range of Fact Sheets available on the ACJ website:
Can you be banned from visiting an aged care resident?
These fact sheets provide information on whether you can lawfully be restricted from visiting an aged care resident, the role of the aged care facility, and what you can do about it. Each State and Territory has specific laws on this matter, and ACJ has provided a fact sheet for each jurisdiction.
When can medication be used to manage a resident's behaviour?
When can physical force be used to restrict the movement of an aged care resident?
When can a mechanical device be used to restrict the movement of an aged care resident?
These fact sheets set out the steps an aged care provider must follow when applying a restrictive practice in aged care. Restrictive practices involve the use of a restraint which could be chemical, physical, mechanical or environmental, for the purpose of managing the care recipient's behaviour. Throughout 2025, ACJ will be releasing fact sheets on environmental restraint and seclusion in residential aged care and how restrictive practices are appropriately applied in home care settings.
